Massachusetts man accused of asbestos abatement violations and intimidation

Two men have been indicted in Norfolk County for allegedly violating state asbestos abatement regulations.

David Einis who owns a rental home in Medway and Nicholas Pasquantonio, a heating contractor, were indicted for two counts of violating the Massachusetts Clean Air Act. The allegations include failing to file a notice of asbestos abatement and failing to prevent asbestos emissions.

Removal and disposal of asbestos is regulated on the state and federal level because it poses significant dangers to human health. When disturbed minute asbestos fibers become airborne they can be inhaled and lead to a number of pulmonary diseases including mesothelioma, a fatal form of lung cancer.

Treatments for mesothelioma can become costly and the law offers these victims the opportunity to recover these costs through civil lawsuits filed on their behalf by mesothelioma attorneys.

Einis hired Pasquantonio to replace the boiler in the rental home occupied by a family with several children. Pasquantonio is not a licensed asbestos contractor. The site was inspected by the Department of Environmental Protection which determined that asbestos was improperly removed and released.

Pasquantonio is also facing a charge of intimidation after he threatened the occupants not to testify against him in court.

Asbestos is a hazardous material and regulations have been put in place to prevent unnecessary exposure by employers. Mesothelioma lawyers can help hold companies and individuals accountable for failing to protect people from the dangers of asbestos. Any person who has developed a health problem because of asbestos exposure can retain a mesothelioma attorney to obtain compensation from a business or individual, who has acted with disregard to their safety.
