John Fautenberry Executed in Ohio For Murder Spree

A former truck driver was executed Tuesday in Ohio for the 1991 murder of a man who gave him a ride. John Fautenberry, 45, was executed Tuesday morning at the Southern Ohio Correctional Facility. He was pronounced dead at 10:37 a.m.

Fautenberry was sentenced to death in July 1992 for the murder of Joseph Daron Jr., who gave him a ride while he was hitch hiking on February 17, 1991. Fautenberry also confessed to killing 5 people in 4 states during a 5 month period in 1990 and early 1991.

Fautenberry’s attorney Dennis Snipe requested that the execution be delayed until a neuropsychologist could examine the Oregon truck driver. Snipe argued that Fautenberry should not be executed because he suffers brain damage from a childhood injury and an injury sustained while serving in the U.S. Navy.

“We make the argument that with a stale psychological survey done in 1996, we thought we needed an updated report to give the clemency process. The Supreme Court said a defendant facing the death penalty was entitled to an attorney; that generally is taken to mean that you should be entitled to one that can effectively defend you, and that includes access to experts where needed,” Snipe said Monday.

The request was denied by the U.S. Supreme Court about an hour before the lethal injection took place.
