San Diego divorce lawyer John Griffith of Griffith & Young recently obtained favorable orders for his client erasing more than $9,000 in child support arrears.
Griffith, as a San Diego family attorney, said the case centered on a claim the wife made against his client for failing to pay child support.
The wife applied for cash aid from San Diego County for a period of more than one year during 1995-96. The couple did not separate until 2001.
She concealed that she was receiving financial assistance and claimed the husband was not supporting the family of which she had custody.
The San Diego District Attorney's office filed a petition to obtain a child support order against the husband.
The husband never received service of the petition and was unaware of the monthly support order until 1999 when his wages were garnished. He confronted his wife and she confessed to the fraud.
For a year, the husband dealt with the County of San Diego to have his $7,000 in child support arrears reduced. The county reduced the arrearage and sent the husband an agreement to sign.
He signed and returned the stipulation and considered all matters settled.
The husband later received a notice that stated he owed more than $8,000 in child support arrears.
In 2012, Griffith took on the case and discovered the stipulation from 2000 regarding child support arrears was never filed.
The divorce attorney argued that his client's support arrears be adjusted per the stipulation which was never filed. Griffith filed a motion for the court to enforce the stipulation even though was nearly 12 years old.
The San Diego Department of Child Support Services claimed that enforcement of the stipulation would be unfair and a family court hearing was set for April.
Prior to the hearing, Griffith met with the DCSS attorney and convinced the county that the stipulation be honored and the case closed.
The husband's $9,000 in child support arrears was erased and the case was closed.
