Pre-Paid Phone Charges Under Investigation

Allegedly, certain pre-paid mobile device companies are forfeiting all the remaining funds in the accounts of customers who fail to pre-pay their monthly or daily payment within 60 days. A number of mobile device companies offer plans for unlimited talk, text, e-mail and internet, so long as the consumer pays a certain amount each day or month for their use. It has been alleged that if a consumer does not make their full monthly or daily payment within 60 days, the mobile device company will take the entire remaining account, even if the consumer later agrees to pay for the service. According to a consumer protection law known as the CARD Act, the value of pre-paid cards cannot expire before five years.

Telephone services are exempt under the CARD Act; however, no such exemption exists for e-mail, texting and internet. Therefore, it is believed that the forfeiture of pre-paid users account funds within 60 days of non-payment may be in violation of this law.
