ClassAction.org is currently offering a free online consultation to any patient who was implanted with a recalled DePuy ASR hip and experienced problems receiving appropriate and timely compensation through the company’s reimbursement process. DePuy established a reimbursement program following the recall of its ASR Hip Resurfacing System and the ASR XL Acetabular System in August 2010, but reports have suggested that the claims process may not being going smoothly for some individuals who have taken the company’s payment offer. If you experienced problems making a claim with DePuy and Broadspire, its third-party administrator of claims, the attorneys working with ClassAction.org would like to hear from you. It is possible that you may still have legal recourse against the manufacturer to seek compensation for medical bills and other damages, some of which may not be recoverable through the reimbursement process. The DePuy ASR Hip Resurfacing System and the ASR XL Acetabular System were recalled after data indicated that a greater number of patients than previously reported needed a second surgery, also known as a revision surgery, earlier than expected. According to data from the UK, approximately 12 percent of patients with the ASR resurfacing device and approximately 13 percent of patients with the ASR total hip replacement had revision surgery within five years of the initial procedure. Patients who were implanted with the
recalled DePuy hips and needed a second surgery reportedly developed a number of symptoms, including pain, swelling and trouble walking. These problems are not unusual following hip replacement surgery, but become worrisome when they persist or recur.
In addition to these problems, the recalled DePuy ASR hip implants have also reportedly been linked to a condition known as metallosis, which occurs when a device’s metal-on-metal components rub against each other releasing potentially dangerous levels of chromium and cobalt ions into the body. If you or a loved one experienced metal poisoning, hip implant failure or other problems with the recalled DePuy ASR hips, you may have legal recourse to recover compensation for damages including future medical expenses and pain and suffering, which are not covered under the reimbursement process. The company is facing a number of lawsuits surrounding these implants and even patients who looked to
DePuy for reimbursement may still have legal action if they are not satisfied with the handling of their claim. For more information, please visit ClassAction.org today.
