There is a growing trend among divorce lawyers; aiming their practice towards men who think they won’t get a fair judgment in court.
Many men fear that judges will unfairly grant custody and support payments to the exes simply because they are women. These firms promise to prevent the men from losing their hard-earned money or being discriminated against when they head to divorce court. One such firm, which is easily visible in an internet search, Cordell and Cordell targets the male audience by crafting their message to imply that men are not treated fairly in divorce and can be taken to the cleaners.
But attorneys from the American Academy of Matrimonial Lawyers say the landscape of divorce has changed over the decades and courts no longer favor one spouse over the other because of gender. The majority if states allow shared custody unless a divorce attorney can prove that is not in the best interest of the child. The majority of states also have property division laws that split a couple’s assets in half. Very few states award women lifetime alimony, which was an issue a few decades ago.
And as women are increasingly becoming breadwinners, some divorce lawyers have seen cases where women are ordered to pay their ex-husbands alimony.
The reality is that the final divorce settlement is awarded within the confines of the law and a judge’s decision. Although a divorce attorney cannot change state law, the divorcing men can make certain that they have an advocate in court and make certain they are treated fairly.
