California Woman Awarded $5.5 Million in Compensation in Vaginal Mesh Lawsuit Against Manufacturer

(New York, NY, July 26, 2012) The Rottenstein Law Group, which represents clients with claims stemming from injuries allegedly caused as a result of surgically implanted vaginal mesh devices, is pleased by the news of a California jury’s award of $5.5 million to a couple who suffered life-altering injuries as a result of the wife’s vaginal mesh implant.

A jury handed down the verdict in a case against C.R. Bard Medical in Kern County Superior Court in California (Scott v. Kannappan, Case no. S-1500-CV-266034), according to KGET-TV 17’s website.

One of the two claimants, Christine Scott, was implanted with Avaulta Mesh, a Bard product, in an effort to correct a “leaky bladder,” according to the news report. The device eventually cut into her colon, and in an effort to correct the damage, she has since undergone eight surgeries and may have to undergo more.

For these injuries, the jury awarded $5 million to Christine Scott and $500,000 to her husband for his loss of consortium, the local news report states.

Christine Scott is reportedly pleased that she can finally warn women about the dangers of vaginal mesh implants—something the court had ordered her to refrain from doing for the four years that her case was pending.

Mrs. Scott is just one of hundreds of women who claim they’ve suffered severe injuries as a result of having received vaginal mesh implants manufactured by C.R. Bard. The trial date for the first of about 600 federal court cases against Bard that have been consolidated in Charleston, West Virginia (in MDL No. 2187) is set for February 5, 2013, according to a May 2, 2012, article that appeared on Businessweek.com.

As a law firm representing many of the claimants in the West Virginia multidistrict litigation against Bard, the Rottenstein Law Group is encouraged by the Kern County Superior Court jury’s decision.
