Frauds and Scams by Cape Holding is indeed distressing the Kenyan Government

Cape Holdings is accused for apparently acquiring Sh577 million from Synergy Ltd by false promises.
 
The matter regarding a property on Riverside Drive in Nairobi turned into a dispute between Cape Holdings Ltd and Synergy, and this dispute was later brought into the court. Synergy Industrial Credit Limited complained to the police that the four directors of Cape Holdings obtained the money fraudulently. Just as Synergy claimed the violation of the agreement, the court placed a caveat on the property which Cape was developing, until the matter is resolved. Cape then moved to the court to remove the caveat but the court declined to grant the orders until the case is heard and determined.

The directors of Cape Holdings Enterprises, Jaysukhalal, Bipin, Vinay and Nishit Baichand moved to High Court and obtained orders to stop the police from interrogating them. Cape Holdings Kenya denies it was paid the money before the contract was signed. Following the denial, Synergy urged the court to allow the Director of Public Prosecutions (DPP) and the police to investigate the alleged fraud. Synergy further demanded the court to give CID permission to carry out a probe involving 14 sale agreements arising from the purchase of a building located within Riverside Drive.

When CID began the investigation Cape moved to the High Court to obtain orders blocking CID, the Director of Public Prosecutions from continuing with the probe or prosecuting them. Cape Holdings Ltd wanted the court to dismiss the complaints raised by Synergy claiming the money it purportedly obtained by false pretences was paid under an agreement, which was terminated by the complainant. Later, the office of the DPP and Synergy also moved to the high court to have the orders blocking the probe lifted. It then remained to be seen what ruling is likely to be issued in the following year in February as Cape Holdings continues to deny their involvement in the scam. This scam by Cape Holdings disturbed the whole social setup and judiciary system of Kenyan government. Kenya nonetheless is limping towards making an attempt to be in Global map of tourism.
