“This is actually the third suit of this kind in which we are currently involved," says partner Deborah Mains. "We are also in suit against two other area casinos for very similar types of gender stereotype paradigms. We understand very clearly that the casinos are an entertainment venue and a service-based industry, and that there are many employees of the casinos who are 'true entertainers.' At the same time, however, there are a number of positions which require only competence, friendliness, good grooming, care and a pleasant demeanor. Cocktail servers and bartenders are those types of positions. Hard working people get those jobs and hold them. They age and cannot necessarily help the fact that they no longer adhere to a particular stereotype that the casinos might want to promote, if they ever did adhere to such a stereotype. This suit, and others of its kind, seek to redress that wrong."
The Golden Nugget suit and others like it are based upon state law which prohibits discrimination based upon a person's willingness to adhere, or not adhere, to gender, sexual or other stereotypes.
