Which Visa is right for me?

The Partner Visa enables eligible partners of Australian citizens, Australian permanent residents or eligible New Zealand citizens to live permanently in Australia.

If you have an Australia spouse that is an Australian citizen, Permanent Resident or eligible New Zealand Citizen you may be able to apply for the Spouse (Subclass 820/309) Visa. With this visa, you will be able to enter and / or remain in Australia on the basis of your marriage to your Australian partner.

Alternatively if you are in a de facto relationship with Australian citizen, Australian permanent resident or eligible New Zealand citizen you may be eligible for the De Facto visa (Subclass 820/309).

For a fiancé of an Australian citizen, Permanent Resident or Eligible New Zealand Citizen, you could apply for a Prospective Marriage (Subclass 300) Visa. You must apply for this visa from outside Australia before marrying your fiancé to have this visa granted.

If you are in a relationship with a New Zealand citizen and want to live in Australia together you may be eligible for the New Zealand Citizen Family Relationship (Subclass 461) Visa.

What do I need to evidence?

There are other basic requirements for the various visas listed above. Being able to solidly evidence the basic aspects of your relationship is vital to lodging as successful visa applciation. This applies to the Spouse, De facto, Fiancé and New Zealand Citizen Family Relationship Visas.

In any of the visas subclasses listed above you need to evidence that your relationship is genuine and that you both have a commitment to each other to the exclusion of all others.

The length of time that you need to have been living together for will also differ for each visa category.

Regardless of which visa you apply for you need to lodge the application with the correct forms, supporting documentation and pay the correct Visa Application Charge fee.
