The California mother who threw her three young sons into the San Francisco Bay in 2005 has been declared insane by Judge Ksenia Tsenin. Rather than serve a mandatory sentence of 15 years to life for second degree murder, Lashuan Harris, 24, will be sent to a mental hospital.
Just yesterday a jury found Harris guilty of second degree murder but the judge’s decision on Wednesday to declare her insane annuls the guilty verdict.
Judge Tsenin agreed with the defense that Harris was schizophrenic and not capable of understanding the severity of her actions when she threw her three sons, ages 6, 2, and 16 months into the water. Harris claimed that she was acting on orders from God.
Harris will remain in a mental hospital indefinitely. If she is ever declared legally sane she can be released.
