Halle Berry and Gabriel Aubry Settle Differences Regarding Daughter Nahla

Halle Berry and Gabriel Aubry are slowly settling their differences. Berry’s attorney Blair Berk confirms the pair has come to an “amicable agreement” regarding custody arrangements for their 4-year-old daughter Nahla. Details on the agreement will not be released.

“There will be no further statements regarding this matter,” Berk said in a written statement.

Now the only thing that remains unsettled is the Thanksgiving Day fight between Aubry and Berry’s fiancé, Olivier Martinez. Although the brawl is still under investigation, Los Angeles Police Department Commander Andrew Smith tells People magazine it appears Aubry initiated the fight. It has not been determined if he will be charged.

In court papers filed earlier this week, Aubry accused Martinez of taking the first punch. The French-Canadian model said he was dropping Nahla off at Berry’s LA home when Martinez angrily approached him about a judge recently denying the actress’s request to move Nahla to France.

"All of a sudden, Mr. Martinez jumped me on the side of my body, and punched me such that he had taken me down to the ground," Aubry stated. "He continued to punch me at least two or three times, kicked me in the ribs with his knee or foot, and took my head in his hands and slammed it to the concrete driveway. It all happened so fast and so suddenly; I did not see Mr. Martinez's actions coming, and thus, I was not ready for it and was not able to defend myself."

Aubry also accused Martinez of threatening to kill him. "You cost us $3 million. When you see the judge, you're going to tell him you're going to Paris or I'm going to kill you,” Martinez allegedly said.
