Lindsay Lohan Innocent Of Assault Charges, Says Lawyer

Lindsay Lohan’s lawyer Mark Heller says the troubled actress is innocent of the assault accusations made against her early Thursday morning by 28-year-old Tiffany Eve Mitchell. Heller tells ABC News Lohan is simply "a victim of someone trying to capture their 15 minutes of fame." He is confident she will be “totally exonerated” of third degree assault.

Speaking to E! News, Heller denied reports the 26-year-old was drunk and on drugs at the time of her arrest outside Manhattan’s Avenue nightclub. "I can tell you when I was with her this morning, she was in great condition," he said. “She was certainly not intoxicated, certainly not under the influence of drugs. She was clear [and] lucid, her eyes were clear. No alcohol involvement whatsoever on this occasion."

According to reports, the alleged attack happened inside Avenue after Lohan asked Mitchell to give her space. An insider said Lohan then sat down briefly, but got back up and punched Mitchell. Mitchell called police and Lohan was immediately arrested.

Heller tells E! he will be “working very earnestly to establish that no charges should even be lodged.” “The police] have already made arrangements to get the video from the...club, which hopefully will reveal some exonerating information,” he added.

Meanwhile, Lohan will face charges in a June car accident. She was charged with three misdemeanors in Los Angeles  just hours after her arrest at Avenue. The charges include reckless driving, providing false information and obstructing or resisting a police officer.

Lohan is accused of lying to police about who was behind the wheel of her Porsche when it collided with a dump truck on Pacific Coast Highway on June 8. Lohan told officers her assistant was driving at the time of the crash, but an investigation determined that it was actually Lohan who was in the driver’s seat.

Her new legal troubles could result in her returning to jail for probation violation. Lohan is currently on informal probation in her 2011 jewelry case. If she violates her probation by breaking any law, Lohan faces 245 days in jail.
