Lindsay Lohan’s Assault Hearing Is Postponed

2013 got off to a good start for Lindsay Lohan – a hearing in her assault case was postponed Monday, and her attorney predicted the misdemeanor assault charge will be dropped.

Speaking to reporters as he left a NYC courthouse, lawyer Mark Heller revealed the defense team has uncovered "very credible evidence and testimony" to support their assertion that Lohan "did absolutely nothing wrong [and] had made no contact” with alleged victim Tiffany Mitchell.

Heller also slammed Mitchell’s fortune teller profession. "From my understanding, Lindsay was being approached by a fortune teller who sought to provide a reading to her and she politely said 'I don't want to participate' and declined. You would think if [Mitchell] was a fortune teller, she would have been able to see this happening in advance. But obviously her skills weren't that honed,” he said.

"It may very well be this case does not move forward...ironically a psychic fortune teller has predicted the year 2013 will be an extremely lucky year for Lindsay Lohan," Heller added.

The Manhattan District Attorney's Office said the assault case remains under investigation. If a criminal complaint is filed, Lohan will be required to appear in court.

Lohan was arrested at Avenue nightclub on November 29 after being accused of punching Mitchell in the face. Mitchell was interviewed by police and released without charge.

Lohan’s legal troubles are not over. She is still facing three misdemeanor charges of reckless driving, providing false information and obstructing or resisting a police officer in connection with a June car accident in Los Angeles. The 26-year is accused of lying to police about who was behind the wheel of her Porsche when it collided with a dump truck on Pacific Coast Highway on June 8. Lohan told officers that her assistant was driving at the time of the crash, but an investigation determined that it was actually the Liz & Dick star who was in the driver’s seat.

The car accident charges prompted L.A. Commissioner Jane Godgrey to revoke Lohan’s probation in her necklace theft case last month. Her next court date is set for January 15.
