ADA Lawyers Want to Hear from Employees Fired Under Maximum Leave Policy

The attorneys working with ClassAction.org are investigating potential lawsuits on behalf of workers who are disabled under the Americans with Disabilities Act (ADA) and were fired based on their employer’s Maximum Leave Policy. Allegedly, some companies are imposing maximum leave policies which violate the rights granted under the ADA, with the EEOC recently settling a handful of lawsuits claiming that unlawful leave policies were imposed on disabled workers. If you are a disabled employee who was fired under your company’s maximum leave policy, you may have legal recourse to recover your job and any additional losses. To find out if you are eligible, visit http://www.classaction.org/maximum-leave-policy-discrimination-under-the-ada.html for more information and a free consultation.

The ADA requires that employers take into account whether a job accommodation, such as transfer to another position, would allow a disabled worker to keep their job. It has been suggested that Maximum Leave Policies that lack exceptions may violate the ADA, and that employers cannot terminate disabled employees who needed time away from work simply by imposing these policies. Employers may be required to take further steps to accommodate disabled employees and ensure they can continue employment with the company; these steps may include reasonable accommodations or additional leave, so long as this does not create undue hardship for the employer.

The EEOC has targeted a number of companies who have allegedly instituted disability leave policies which violated the rights supplied under the ADA. As a result of these findings, the attorneys working with ClassAction.org are extending a free consultation to any disabled employee who believes they were discriminated against after being fired under their company’s maximum leave policy.
