Bernstein Liebhard LLP Announces Filing of Yasmin & YAZ Lawsuit
Bernstein Liebhard LLP announced that on October 7, 2009, the firm filed a lawsuit in federal court in New York against Bayer, the manufacturer of Yasmin and YAZ birth control pills, on behalf of Scott and Heather Crawford, Crawford v. Bayer et. al. 7:09-cv-8550 (S.D.N.Y.). The complaint alleges eleven causes of action including claims for strict product liability, negligence, breach of warranty, negligent misrepresentation and/or fraud, violation of New York’s General Business Law and loss of consortium.
Heather Crawford was prescribed and began using YAZ in 2007. Later that same year, she was diagnosed with a pulmonary embolism, which is a life-threatening blood clot in the lungs. According to the lawsuit against Bayer, Ms. Crawford’s pulmonary embolism was a direct result of her use of YAZ.
YAZ & Yasmin Lawsuits
Bayer currently faces dozens of YAZ lawsuits and Yasmin lawsuits and the number continues to grow. The lawsuits all involve allegations that a newer generation progestin contained in the Yaz and Yasmin birth control pills, called drospirenone, increases the risk of serious and potentially life-threatening YAZ and Yasmin side effects, including heart attack, stroke, pulmonary embolism, deep vein thrombosis, gallbladder disease and sudden death. The YAZ and Yasmin lawsuits also allege that Bayer overstated the benefits of YAZ and Yasmin and failed to adequately warn consumers about serious risks associated with YAZ and Yasmin.
On October 1, 2009, the U.S. Judicial Panel on Multidistrict Litigation issued an order establishing a multidistrict litigation, or MDL, for all federal YAZ and Yasmin litigation. Pursuant to the order, all YAZ and Yasmin birth control pill lawsuits currently pending in federal courts will be consolidated and centralized in the Southern District of Illinois for coordinated pretrial proceedings. This will benefit the plaintiffs by allowing them to share in the costs of pre-trial discovery while avoiding duplicate discovery.
