Mirena Lawsuit Update: NJ High Court Consolidates Statewide Cases

The NJ Supreme Court has announced the consolidation of statewide Mirena claims into a multicounty litigation matter, Class Action.org reports. According to a Notice to the Bar dated May 24, 2013, Superior Court Judge Brian R. Martinotti will oversee the claims, which pertain to the implications of the Mirena, an intrauterine device made by Bayer HealthCare Pharmaceuticals Inc. According to the lawsuits, women who used Mirena were not fully informed of the risks of the IUD. Specifically, it has been alleged that Mirena can embed itself in the uterus, perforate the uterus and/or travel into the pelvic area, which may cause adhesions and organ damage, among other problems.

Since its approval in 2000, Mirena has prompted a number of adverse event reports to the FDA. These reported complications include ectopic pregnancy (a pregnancy in which the fertilized egg grows outside the uterus), intrauterine pregnancy (a pregnancy with Mirena in place), and pelvic inflammatory disease. Additionally, in 2009 the FDA sent a letter to Bayer stating that specific claims made during “Mirena Parties,” a direct marketing program, were misleading. The FDA claimed that the script read by nurses at these “parties” minimized the risks of Mirena.

According to reports, more than 60 pending cases in New Jersey against Bayer are being consolidated. Any further lawsuits filed against Bayer relating to Mirena will be assigned to Judge Martinotti.
