The bill was introduced by U.S. Rep. Gregg Harper (R—Miss.) to address the section of a 1938 labor law that enables employers to provide unfair and immoral subminimum wage pay to workers with disabilities. Under the current law, employers can apply for federal waivers to pay disabled employees less than minimum wage, which is allowing some employers to pay disabled workers as little as three cents per hour.

“The fact that this law is still in effect is a travesty,” said Steve A. Troutman of the current law. “First of all, keep in mind we’re asking this of people who have already had to overcome so much more than your average person to just be able to even put in a day’s work. On top of that, some of these disabled workers are being paid, literally, pennies on the dollar in comparison to their co-workers to do the same work. Hopefully, this bill can bring an end to that.”

The bill would require the Secretary of Labor to discontinue the issuance of new special wage certificates and revoke waivers issued within one to three years after their enactment.
