Keolis Paratransit Drivers Denied Overtime Pay May Have Legal Recourse

The attorneys working with ClassAction.org are investigating whether Keolis paratransit drivers have legal recourse to collect compensation for unpaid overtime wages. They are currently looking into allegations that these drivers, who transport the disabled and handicapped, were misclassified as independent contractors and therefore denied proper overtime wages.

If you are a current or former paratransit driver for Keolis, the attorneys working with ClassAction.org would like to hear from you to assist in their investigation. The Fair Labor Standards Act (FLSA), which establishes minimum wage, overtime pay and other employment standards, applies only to employees and not independent contractors. Independent contractors are typically hired to work on specific projects, and unlike employees, do not have to be paid in accordance with the FLSA. Employers in a variety of industries, ranging from cable installation to delivery services, have faced lawsuits alleging that they misclassified their workers as independent contractors to avoid paying overtime pay or otherwise complying with the FLSA. The attorneys working with ClassAction.org are currently trying to determine whether a similar case can be brought against Keolis in light of allegations that the company misclassified its paratransit drivers as independent contractors.

A number of factors will be considered in determining whether a worker is considered an employee or independent contractor. One of the most significant factors in making this important distinction is whether the business that hired the individual has the right to direct and control how the work is performed. If the business has the right to direct and control the work, the worker is more likely to be considered an employee, rather than an independent contractor.

If you work as a driver in the paratransit industry and have not been paid overtime, you may have legal recourse to collect compensation for your unpaid wages. For more information, please visit ClassAction.org. On the site, you can receive a free, no obligation review of your claim.
