Attorneys Working With ClassAction.org Need to Hear from 23andMe DNA Test Kit Users

The attorneys working with ClassAction.org are investigating potential claims on behalf of consumers who purchased a DNA test kit from 23andMe Inc. The kit sells for $99 and is marketed to provide information on a user’s health risks and genetic markers for disease. The manufacturer is currently facing a putative class action lawsuit in California where consumers allege that the company falsely and misleadingly advertised the kit because its results are not supported by any scientific evidence. In light of these allegations, the lawyers working with ClassAction.org would like to hear from anyone who has purchased the kit to help assist in their investigation.

Consumers who purchased the DNA test kit can visit http://www.classaction.org/23andme-dna-spit-kit.html and fill out the free case evaluation form for more information.

According to court documents, 23andMe falsely and misleadingly advertised its Saliva Collection Kit/Personal Genome Services (PGS) kit as “providing ‘health reports on 240+ conditions and traits,’ ‘drug response,’ ‘carrier status,’ among other things when there is no analytical or clinical validation for the PGS for its advertised uses.” NBC News reported that plaintiffs are also accusing the company of marketing the genetic samples to scientists for research.

The lawsuit was filed just days after the U.S. Food and Drug Administration (FDA) sent a warning letter to 23andMe, advising the company that products used to diagnose, mitigate, or prevent disease need FDA clearance and demanded that 23andMe stop selling its PGS kit. The FDA warned 23andMe that it may be forced to take legal action against the manufacturer if it did not immediately stop all marketing for the product and submit clinical data supporting the kit’s accuracy. The FDA also expressed concern that a false negative or false positive reading for certain genetic risk factors or diseases could cause serious health consequences for users who rely on these results in seeking medical treatment.

If you have purchased the PGS kit from 23andMe, the attorneys working with ClassAction.org would like to hear from you. They are currently reviewing claims on behalf of DNA kit users, and believe those who purchased the kit may be eligible for compensation.
