Attorneys working with ClassAction.org are reviewing claims on behalf of property owners who are experiencing problems with their Architect and/or Designer Series Pella windows. Multiple class action lawsuits have been filed against Pella alleging that these windows are defective because moisture can get trapped behind the aluminum cladding, the part responsible for diverting water away from the window. As a result, property owners claim that they have spent thousands of dollars replacing or repairing rotting windows and surrounding areas that suffered water damage.
According to the lawsuits, the aluminum cladding surrounding these windows does not keep water away from the wooden frame. Furthermore, the design of these windows allegedly masks the water-damaged areas, causing the problems to go unnoticed and forcing many property owners to pay to replace the windows themselves after their warranties expired.
Some who were able to submit warranty claims allege that Pella denied their claims without explanation or blamed the problems on improper installation and high moisture levels in their homes; however, property owners allege that professional testing proved that their homes did not exhibit high levels of moisture. In fact, some of these houses were determined to have low moisture levels.
Several property owners have taken their complaints online to the website ConsumerAffairs.com. A slew of one-star reviews claim that property owners began experiencing problems with their Pella windows as early as two years after they were installed. Some reported spending $10,000 to remove and replace the rotting windows, and others claim that Pella charged them $100 service fees to inspect their windows and attempt to solve the problems using foam seals or rubber stoppers.
According to the lawsuit, Pella knew its windows could fail well before their expected lifetime – even when installed properly – and the plaintiffs allege that the company purposely drafted its warranty to avoid consumers’ claims for replacement windows.
In addition to compensation for the cost of the windows, the plaintiffs are requesting that Pella reassess all of the previously denied warranty claims and inspect properties for signs of rotting and other damage.
