Nigerian Court Dismisses Request for Interim Leader while President Umaru Yar’Adua Remains Hospitalized

Nigeria’s high court has rejected a request from the Nigerian Bar Association (NBA) that called for an interim leader to be appointed while President Umaru Yar’Adua remains hospitalized outside the country.

 

In announcing the decision federal high court judge Dan Abutu said “The failure to transmit a written declaration to the national assembly before proceeding on vacation is not unconstitutional.” That “vacation” has now extended to more than two months in Saudi Arabia as Yar’Adua continues to receive treatment for a heart condition.

 

There have been demands Yar’Adua hand power over to Vice-President Goodluck Jonathan but the president is unlikely to take such an action due to their party’s practice of alternating power between the north and the south.

 

Yar’Adua is a northerner while Jonathan is from the south and if power were to be turned over it would represent a shorter term of power for the north despite the fact both men are members of the People’s Democratic Party.
