U.S. District Judge Manuel Real declined a request from Robert De Niro to throw out a lawsuit alleging that the actor misrepresented his health when he signed a movie production insurance form in October 2003.
The lawsuit, filed by the Fireman’s Fund Insurance Co., claims that the 63-year-old De Niro misrepresented his health when he wrote that he had never been diagnosed with or treated for Prostate cancer.
Just two days after signing the insurance form De Niro was revealed to have prostate cancer and then underwent a prostate-gland biopsy shortly after.
As a result of the diagnosis the film De Niro was working on, “Hide and Seek,” was delayed for an extended period, costing the insurance company nearly $2 million that it had to pay the movie’s production company Fox.
As a result of Real’s decision the parties are expected back in court on July 2 to determine if the case should be heard in state court.
De Niro won an Academy Award as best supporting actor in 1974 for the film “The Godfather, Part II” and won again in 1980 when he took home the best actor award for “Raging Bull.”
