Dangers of Student Loan Default: Wage and Tax Garnishment

Student Loan Law Group understands the variety of reasons why many borrowers find themselves in default on their student loan debt. Financial hardships are common and often occur through no fault of the borrower. Borrowers may incur unexpected expenses, such as vehicle repairs or maintenance, or may be let go from their jobs as a result of the poor economy. Financial hardships can also occur from injuries sustained in motor vehicle accidents or on the job or as a result of being diagnosed with a serious illness or experiencing a medical emergency. Whatever the reason that an individual borrower has fallen behind on his or her student loans, the debt collectors are unsympathetic. Student Loan Law Group wants to help!

Debt collectors attempting to collect on student loan debt do not care about borrowers’ personal situations. If a student loan account is more than five (5) months past due, the account may be declared in default. If a borrower’s loans reach a default status, that borrower can expect to have his or her paychecks and tax returns seized. Legally, only a portion of a paycheck may be seized from a borrower in default on his or her student loans. However, the entire tax return that either the borrower or the borrower’s spouse is entitled to may be seized.

These consequences are frequently referred to as wage and tax garnishments. Wage and tax garnishments are very difficult to fight without an attorney. Once notice of impending garnishment occurs, borrowers really need the help of a licensed attorney to protect their rights. Student Loan Law Group is run by licensed attorneys who can represent borrowers in court proceedings. Our attorneys will fight to protect borrowers’ rights and prevent impending garnishment from occurring or end their garnishment as quickly as possible. Borrowers should not delay if they have received notice their student loans are in default or will soon be declared in default. Contact Student Loan Law Group now for legal advice.
