Pressure on Fiat Chrysler for its gross mishandling of defective Dodge Ram pick up trucks has drawn both fines and an unprecedented forced vehicle buy back from federal regulators. The trucks have a serious safety defect which can cause the vehicles air bag to deploy unexpectedly. The cause for this potentially deadly defect has been identified as a problem that happens when the wiring harness in the steering column rubs against the driver air bag. Over time this wears off the wiring insulation and can cause a short. This in turn can deploy the air bag unexpectedly when the vehicle is being driven.
Citing a pattern of poor performance of effectively dealing with safety recalls, including failing to notify owners of defects and failing to take appropriate actions, federal regulators have increased pressure on the automaker.
Chrysler must recall more than one million Ram trucks for repairs. In addition to the recalls, more harsh actions have been taken to send a strong message to automakers including making Chrysler buy back defective vehicles, paying consumers to participate in one recall, and “give broad authority to an independent monitor to oversee its safety operations.” Chrysler must also develop a consumer education program to keep vehicle owners aware of safety recalls.
While the penalties and fines from NHTSA have been stepped up, the pressure falls short of sending a complaint to the United States Justice Department, something many independent observers feel would be appropriate give the scale of negligence in this safety recall.
Injury attorney Bernard F. Walsh had this to say about the actions by federal regulators, “The actions and lack of action by this auto manufacturer has put many citizens at risk. This manufacturer intentionally failed to produce the necessary data for the government to demand a recall. This gross negligent and/or intentional endangering of our citizens is something that needs the Department of Justice to initiate a criminal investigation.”
