Nicole Richie was granted a trial delay after her lawyer, Shawn Chapman Holley, argued that the case should be delayed because a drug-expert, Dr. Terence McGee, could not make the hearing due to traveling.
The trial was scheduled to begin today but Los Angeles County Commissioner Steven Lubell allowed the delay but ordered Richie to appear in court on August 16.
Holley claims that Richie’s urine test the night of her arrest is “unreliable” and Dr. McGee can show evidence of that. “Dr. Terence McGee is going to challenge the prosecution’s scientific evidence. Observations were made of Ms. Richie that he can [refute],” said Holley.
Holley refused to accept a plea deal that was offered to Richie. Richie is pleading not guilty and faces a minimum sentence of four days in jail and three years probation. This is the second DUI offense for the “Simple Life” star.
