Apple Inc., maker of the popular iPhone, sued Taiwan-based phone maker HTC on the basis that the company violated their patents. HTC is among the leading competitors for Apple’s smart phone, having manufactured the first phone to operate on Google Inc.’s Android platform as well as is Nexus One mobile phone, which the company sells directly.
Apple alleges that HTC has infringed upon 20 of its patents ranging from hardware to its user interface and touch screen technology. They are pursuing unspecified damages and looking to bar HTC from selling the products that employ their patented technology from being sold in the U.S.
Apple CEO, Steve Jobs has tired of the violations, which have become increasingly troublesome as more competition for smart phones infiltrates the market.
"We can sit by and watch competitors steal our patented inventions, or we can do something about it, " Jobs said in a statement. "We've decided to do something about it."
Whether the something Jobs is referring to will be effective in blocking the sale of the Android phone; however remains to be seen. Considering the length of time it may take for a ruling in a patent case, it may be too late to prevent damages to Apple’s market share by HTC products.
HTC has yet to release an official statement in reference to the suit, only finding out about through the media on Tuesday.
Apple filed the complaints with the U.S. International Trade Commission and the U.S. District Court in Wilmington, Del.. The ITC can prevent the importation of products and parts employing contested technology while the Court will determine damages.
Shares of the California based Apple gained 72 cents to trade at $209.71 at midday on Tuesday.
