William Castillo execution halted

William Castillo was not executed by lethal injection Monday as scheduled. Lawyers from the Nevada American Civil Liberties Union filed a petition to halt the execution because death by lethal injection may be unconstitutional. Castillo refused to file appeals of his own.

The issue of lethal injections has been brought to the Supreme courts attention after some believe the prisoner may be in excruciating pain before death and not able to cry out because of a drug that renders the inmate of any body movement, therefore making them unable to show any outward signs of pain. Some argue that the drug would make lethal injections unconstitutional because it would be cruel and unusual punishment.

 

The lawyers argued Castillo was protected from cruel and unusual punishment by the 8th amendment. The court has allowed lawyers on both sides 60 days to prepare briefs. Arguments will be heard, and a final decision will be made.

 

Castillo received the death sentence after he was convicted of brutally murdering 86-year-old Isabelle Berndt with a tire iron. He and a woman accomplice robbed Berndt after murdering her and set her house on fire to cover the evidence.
