Joran van der Sloot Conviction Not Easy Says Official

According to a report from ABC it may be difficult to build a case against Joran van der Sloot for the 2005 murder of Natalee Holloway. Many believe it will be easy to convict van der Sloot after a taped confession was revealed this past week.

In the video, provided by Dutch crime reporter Peter de Vries, van der Sloot describes how he and Holloway, 18, were on a beach in Aruba when she began shaking and suddenly slumped over. He then says he called a friend to dispose of her body in the ocean.

 

According to Aruba advocate general Nico Jorg, a case against van der Sloot won’t be as easy as many expect. In an interview with ABC, Jorg says there is no trail by jury in Aruba and a suspect’s words can’t be used against them.

 

Jorg says for van der Sloot to be sentenced to life in prison prosecutors would have to prove that the 20-year-old aided first degree murder. They would be required to prove “conditional intent” on van der Sloots part.

 

Van der Sloot could receive as many as 9 years in prison if convicted of injury to health causing death. Prosecutors would have to prove van der Sloot knowingly gave Holloway an excess of alcohol.

 

He could also be charged with accidental death and receive 9 months in prison if prosecutors were able to convince the judge that van der Sloot did not take precautions after Holloway fell over.

 

Another possibility is illegal disposal of a corpse. If convicted he would face 6 months in prison. Van der Sloot could be charged with not giving help to someone in need which holds a sentence of 6 months.

 

Jorg says that since van der Sloot has already spent time in prison that time would be deducted from any sentence he might receive.

 

Holloway went missing in May 2005 while on a senior trip to Aruba with several of her class mates. Her body has never been found.
