Shareholders have been fighting for a fair investigation since the Bank’s collapse in 2008. Judge Mary Walrath rejected the shareholders prior request for an examiner because WaMu and its creditors have conducted an investigation into the assets held by the estate and would share the results with the shareholders.

Shareholders of WaMu appealed Walrath’s decision last week and Walrath let their appeal go directly to the Court of Appeals r the Third Circuit, bypassing the district court. An official committee which represents shareholders had said that the investigation which previously took place by WaMu and its creditors was “minimal at best.”
