Carol Gatbaum Family Files Wrongful Death Suit

The family of Carol Gatbaum is taking steps to file a wrongful death suit against the city of Phoenix and its police department. Gatbaum died last year while in the custody of police at Arizona’s Sky Harbor International Airport. The 45-year-old’s death was ruled an accident by the medical examiner but her family accuses police of “using excessive and unreasonable force.”

“Good people here made lethal, unreasonable mistakes, with catastrophic results for Carol, her three small children and for her husband,” the $8 million claim says.

 

Gotbaum missed her connecting flight on Setember 28 and flew into an angry rage. Police said she was “uncooperative” and resisted arrest.  She was taken into custody by airport police and placed in a holding cell. She accidentally strangled herself while attempting to free herself of the handcuffs.

 

Gotbaum was intoxicated at the time of the arrest. Her family said she was on her way to an alcohol rehabilitation center in Tuscon, Arizona.

 

The Gotbaum family’s claim says Carol was treated “as if she was a dangerous criminal, rather than as a sick, intoxicated and vulnerable person she was. She had no weapon and never threatened anyone.”

 

City attorney’s say officers conducted themselves and the arrest properly. “The Gotbaum family has publiclly admitted, not only that Carol hid her medical and mental condition, but that the officers responded to Carol exactly the way her husband knew they would respond because they did not critical information known only to the Gotbaum family,” the attorney said.
