International Court of Justice Rules Kosovo’s Declaration of Independence Legal

The International Court of Justice has ruled that Kosovo’s declaration of independence from Serbia in 2008 was not illegal, declaring the act did not violate Serbia’s territorial integrity. The ruling was handed down by ICJ president Hisashi Owada who said the court “concludes that the declaration of independence on 17 February 2008 did not violate general international law.”

 

With the ruling Kosovo has said Serbia must now address them as a sovereign nation, something Serbia has vowed to avoid.

 

While the court’s ruling is considered non-binding it could be used to establish a framework for other countries who attempt to set up a working relationship between Kosovo and Serbia.

 

International support for Kosovo’s independence has been voiced by the United States, Japan, Germany, France, UK, Italy, Turkey, Albania, Croatia, Montenegro and Macedonia but there are also several countries who have sided with Serbia in the matter including Russia, China, India, Spain, Greece, Romania, Slovakia, Cyprus and Bosnia.
