US Supreme Court Rules Guantanamo Detainees Can Challenge Detention

The US Supreme Court ruled in a 5-4 decision on Thursday that foreign suspects held in detention centers at Guantanamo Bay, Cuba have the right to challenge their incarceration through US civilian courts.

 

Many of the 270 detainees being held at Guantanamo Bay have yet to be charged with a crime, rather they are suspected of terrorism or links to terrorist organizations.

 

Speaking for the majority vote Justice Anthony Kennedy noted “The laws and constitution are designed to survive, and remain in force, in extraordinary times."

 

The ruling overturned an earlier ruling that stripped detainees’ rights to challenge their detention through judicial review.
