Supreme Court Rules Against Environmentalists in Border Fence Fight

Environmental groups suffered a serious setback on Monday as the Supreme Court ruled against their plea to end the ability of border fence officials to ignore environmental laws and regulations while building the structure along the United States and Mexico.

In 2005 Congress approved an almost absolute authority for Homeland Security Secretary Michael Chertoff who was entrusted with the construction. Environmental groups have taken exception with the manner in which the fence has been constructed, claiming several laws have been ignored that would protect areas where the fence is going up.

The Supreme Court case was dealing directly with a  two-mile stretch in the San Pedro Riparian National Conservation Area near Naco, AZ.
