FLORIDA FATHER DENIED PARENTAL RIGHTS, DNA PATERNITY TEST AND OFFERED “LARGE SUMS OF MONEY” TO WALK AWAY FROM OWN SON BY GRANDPARENTS

COURTS HAVE THE ABILITY TO DETERMINE FATHERHOOD OR ALLOW THE AGONY OF GUESSING TO END

In a time where most unmarried fathers run and hide from the responsibilities associated with their pregnant girlfriends and their children born out of wedlock, Robert Fedderwitz is pleading for his paternal rights and is willing to voluntarily accept the burden. The mother on the other hand, is looking to stonewall him and deny him his right to parent his son.

Fedderwitz already missed the first ten months of his son’s life and he is fighting with all of his heart and soul to not lose him forever.

After being told by fiancée Jenna Pelusio that she was pregnant with their child, Fedderwitz thought it was the beginning of the family life he had always dreamed of having.  Instead of passing out cigars at the time of the baby’s birth, Fedderwitz served Pelusio with a Paternity action to stake his claim in his child’s life.  He is now fighting endless court battles, initially, just to have a simple paternity test taken by all involved.  He is also facing the risk of losing all parental rights to his son forever.

According to Fedderwitz, his fiancé left their Florida home in her final month of pregnancy, telling Fedderwitz that she needed to go on the trip to New Jersey to attend a baby shower that was being hosted by her mother.  Against medical advice, Pelusio left the state of Florida knowing full well that her "one-way" ticket to New Jersey and her promise to return in a few days were her first of a series of deceitful actions to deny Fedderwitz his paternal rights indefinitely. Pelusio is now denying that the child that they talked about having and then conceived is not his.  Fedderwitz claims that she told him that grandparents Jack and Deborah Pelusio of Long Branch, NJ went so far as to offer Fedderwitz a “large sum of cash” in exchange for his child, where they “asked” him to walk away from their grandson and surrender his parental rights and sign an Affidavit of Non-Paternity.

Monmouth County residents should pay particular attention to this litigation that is pending before Judge Teresa Coyle in the Chancery Division, Family Part, with a case number of FD-13-001415-08A.   All residents, especially those that live on Cooper Avenue, will learn all about their neighbor’s scheme to conspire to commit paternity fraud and learn how a rich family and a morally bankrupt lawyer can seek to pretend that a bond between a father and his child does not exist.

Fedderwitz appeared in Court, by phone, on April 28, 2008, and asked for a DNA test.  The Judge said that she would take it under advisement and it was tabled until the next hearing.  The father was next set to appear in the same Court on Monday, June 9, 2008 to take the DNA test, which was going to be a no-brainer, to finally prove his fatherhood.

It never happened.  Ms. Pelusio's lawyer, Michael K.W. Nolan sought an eleventh hour continuance, which was granted.  The hearing is now continued for a return date of July 2, 2008.

Considering matters dealing with Father’s Rights, Fedderwitz cannot understand how the Pelusios could be so cruel to deny their grandson a father.

“When I asked Mr. Nolan why he would not consent to our simple request of a DNA test, using saliva and not blood, he responded by stating that the test is too intrusive.  I pointed out that all we needed was one of the baby's teething rings or pacifiers and one of the mother's empty wine glasses and we would have more evidence of DNA than necessary.  It is shocking to the conscience at not only how a mother and grandparents would want this to occur, but how a member of the Bar that is sworn to fairness, honesty and integrity, would be a willing participant to this fraud.”

Fedderwitz vows to continue his relentless and tireless pursuit of setting the record straight and walking out of the Courtroom with the child one day. “I am prepared to fight this to get conclusive paternal proof and justice for both of us, my son and me.”

Fedderwitz, who has since gone back to school to study law so that he can help fathers in similar situations, is taking his case to the media to expose this travesty that Nolan is turning into a mockery.  He has also consulted with public interest groups and father’s rights advocacy groups to seek guidance and build up an army to fight for his parental rights.

Fedderwitz vows, “My son deserves a father and I plan to fight for his rights and mine, I will be here for him forever.  No one will ever get between my son and me, and I will fight for our relationship and give him my love until the day that my heart stops beating. ”
