On August 26, 2010, DePuy Orthopaedics Inc., a division of Johnson & Johnson, announced it was recalling two of its ASR (Articular Surface Replacement) hip implant devices. The recall was prompted by new data showing a higher than normal failure rate of the ASR XL Acetabular System and the ASR Hip Resurfacing System. The lawyers at Bernstein Liebhard LLP are investigating potential cases against DePuy Orthopaedics and are offering free confidential legal consultations to individuals who received the DePuy ASR implants and have or are currently experiencing: unexplained hip pain, loosening of their hip implant, failure of the hip replacement, or additional hip surgery to revise their implant.
DePuy ASR System
The DePuy ASR System is a large diameter, high performance metal-on-metal hip resurfacing device preferred by surgeons for young patients who typically benefit from the stability of the device, thus limiting the chance of repeated dislocation. However, problems with the hip implants began shortly after they were introduced to the market in 2003 and 2004. The Depuy hip recall resulted only after hundreds of reports to the FDA of adverse events associated with the Depuy ASR hip implants and reports of high metal ion levels being found in patients. Individuals who have received a DePuy ASR hip implant should contact their orthopedic surgeon for an evaluation of the device to determine if they may be experiencing problems.
Hip Implant Lawsuits
Lawsuits have already been filed alleging Depuy Orthopaedics knew its hip implants were defective based on over 300 complaints it received in 2009 alone, yet took no action to correct the defects. Most of the complaints involve situations where additional surgery was required to replace the defective hip implants.
