Texas Prepared to Execute Jose Medellin Despite International Court of Justice Ruling

The execution of Texas inmate Jose Medellin is still scheduled for Tuesday evening despite a ruling from the International Court of Justice which stated the Mexican national was entitled to a new trial.

 

Medellin, now 33-years-old, has been on death row since he was 18-years-old following his conviction for the brutal rape and murder of 16-years-old Elizabeth Pena. Pena was one of two girls raped and murdered by a Houston gang, of which Medellin was a member, in 1993.

 

Medellin was found guilty and sentenced to death for the murder of Pena but the International Court of Justice declared Medellin had his rights violated because he was never told he could contact a consular official.

 

While Texas admitted Medellin was never told of his consular rights, they argued that he forfeited those rights by not bringing the issue up during his trial. Texas has no plan on backing down from its execution, stating the ICJ has no authority over the state’s courts.

 

The execution is scheduled for 6:00 pm local time.
