As well, one of the plaintiffs alleges in a collective action - a type of class action - under the Fair Labor Standards Act that certain Atlanticare 'business units' systematically violate federal wage and hour laws as to certain classifications of employees.
Partner Deborah Mains says that she hopes through litigation that the truth will emerge and that, if the allegations are true, that justice will be served: "Wage and Hour violations are serious not only to the people who work so hard for what seems like less and less in America today, but also because wide spread violations take hundreds of thousands, and in certain cases millions, of earned dollars from working families. Even if the violations for each worker are not large, it all adds up."
Deborah's partner Kevin Costello adds that the individual racial harassment and
discrimination claims are also important and that he hopes the court process will produce a just result for all parties: "If it's true that African-American employees have been subject to racist comments from managers and denied promotions and fair treatment, then our
Law Against Discrimination has been violated. We'll see what emerges during the course of discovery and trial."
