Connecticut Supreme Court Lifts Ban on Gay Marriages

Connecticut has become the third state to lift the ban on same-sex marriages. The Connecticut Supreme Court ruled Friday that gay and lesbian couples have the right to be legally married.

The ruling comes months after Massachusetts and California gave same-sex couples the right to wed.

“Interpreting our state constitutional provision in accordance with firmly established equal protection principles leads inevitably to the conclusion that gay persons are entitled to marry the otherwise qualified same sex partner of their choice,” Connecticut’s ruling said. “To decide otherwise would require us to apply one set of constitutional principles to gay persons and another to all others. The guarantee of equal protection under the law, and out obligation to uphold that command, forbids us from doing so. In accordance with these state constitutional requirements, same sex couples cannot be denied the freedom to marry.”

In 2005, Connecticut allowed civil unions, which let same-sex couple’s only enjoy the state benefits of marriage and not Federal benefits. Eight gay or lesbian couple’s sued the state, arguing that civil unions were not equal to marriage. Vermont, New Hampshire and New Jersey also allow civil unions.

“Today is really a great day for equality in Connecticut,” said a lawyer for Gay and Lesbian Advocates and Defenders, which argued the case before the Supreme Court. “Today’s decision really fulfills the hopes and dreams of gay and lesbian couples in Connecticut to live as full and equal citizens.”

It is unclear when Connecticut will begin issuing marriage licenses to gay and lesbian couples.
