Jaime Pressly could face a custody battle over the care of her three-year-old son.
The 'My Name Is Earl' star - who recently filed for divorce from husband Simran Singh after just 16 months of marriage, owes over $600,000 in taxes and was arrested last month - has three-year-old Dezi with former fiance Eric Calvo, and though she currently has a cordial relationship with the DJ, his mother Nairis Calvo believes the situation may change because of the disruptions in the actress' personal life.
Nairis said: "Little Dezi is the most important thing in my son's life, and we will do anything to protect him.
"Jaime and Eric have always had a nice relationship when it comes to my grandson Dezi, but that could change.
"My son remains focused on Dezi and everything is good with our family and my grandson. We're very protective of Dezi and want nothing but the best for that precious boy."
As well as her marriage split, 33-year-old Jaime is currently being pursued for $637,000 in unpaid taxes and was arrested last month for allegedly driving under the influence.
Despite her comments, Nairis insists she wishes the actress the best.
She added to RadarOnline.com: "Jaime is in the past and we wish her well... She's been through a lot. It's a tough situation."
It was revealed last week that Jaime - who cited "irreconcilable differences" in her divorce petition - is concerned about how her marital split will impact on her young son.
A source said: "She doesn't want to confuse him. Her baby is her top priority. She's a strong girl though and she will come out of this fine."
