Weld County District Attorney’s Office appeals court decision to cease illegal immigration investigation

The Weld County District Attorney's Office is appealing a ruling that ended an illegal immigration investigation using records from a Greeley tax preparer.

District Judge Stephen Schapanski in December ruled that the investigation by the Weld County District Attorney Ken Buck and Sheriff John Cook should cease. 

The injunction resulted from an American Civil Liberties Union (ACLU) lawsuit that claimed Buck and Cooke’s investigation, known as “Operation Numbers Game,” was tapping into constitutionally protected information that was confidential, and in turn, was taken unlawfully. 

In a similar case in December, 2009, the Colorado Supreme Court ruled that the Operation Numbers Game’s seizure of tax records from Amalia's Translation and Tax Service also violated the defendants’ right to privacy. 

According to Buck, they continued their investigation but stopped using the files that were in question during that case.  

The ACLU filed their lawsuit shortly after the ruling and asked that all the documents obtained from Amalia's Translation and Tax Service be destroyed.

In December, 2010, Weld County was ordered by another judge to destroy the documents but they were no longer being used by the organization for their investigation. According to Buck, this ruling was “redundant” and a lawyer for Buck and Cooke filed a formal appeal of the court’s decision on January 31.A hearing for the case will most likely take place over the summer.
