Lindsay Lohan's friend calls for felony case to be thrown out

Lindsay Lohan's friend is calling for her felony grand theft case to be thrown out of court.

British socialite Lady Victoria Hervey believes the case has no grounding after it emerged jeweler Kamofie & Company - who have accused the actress of stealing a $2,500 necklace - sold the CCTV footage of Lindsay in their store.

She told website Radaronline.com: "The case should be thrown out now.

"One doesn't need to be a rocket scientist to see that these jewellers have totally used this situation for press."

'Mean Girls' star Lindsay - who completed a court ordered stint in rehab in January and is presently on probation - maintains she was leant the necklace from the company's store in Venice, California.

She is due back in court on Thursday (10.03.11) where she will has to decide whether to accept a plea bargain in the case, which would most likely see her sent to jail for between three and six months.

Legal experts believe the sale of the footage of Lindsay, 24, could work to her advantage, however, and enable her lawyer, Shawn Chapman Holley, to bargain for less jail time.

A source said: "The owners of the store's credibility is on the line, and going to be scrutinised. The price of the necklace is going to be revisited again. For Lindsay to be charged with a felony, the necklace had to be priced at over $900.

"Holley has an excellent argument that the owners could have inflated the price of the necklace to the authorities.

"Holley will likely ask that in light of these new developments that Lindsay be sentenced to jail for no more than one to thirty days. If she got sentenced to thirty days, she would serve about seven days."

If Lindsay does not take a plea deal the case will proceed to trial, and she will face a much longer jail sentence if then convicted of stealing the necklace.
