Lindsay Lohan has rejected her plea bargain deal.
The troubled actress is due to appear in court today (10.03.11) after being accused of stealing a $2,500 necklace from jewellers Kamofie & Company, but she has decided not to plead guilty even though she was promised a lesser sentence by the Los Angeles District Attorney (DA) and Judge Keith Schwartz.
A source said: "Judge Schwartz indicated he would give Lindsay less than the six months the DA was seeking, if she pled in front of him.
"Lindsay's lawyer Shawn Holley was asking for no jail time, but the judge said he would sentence her to a minimum of 60 days, but likely not longer than 90 days."
Judge Schwartz has reportedly "encouraged Holly to discuss what not taking the plea deal will mean" for Lindsay.
During today's hearing, the judge will lay out the next steps in the case, which could include scheduling a preliminary hearing during which prosecutors would present some of their evidence.
If Lindsay doesn't take a plea deal, her case will proceed to trial, and she will face a much longer sentence if found guilty, as she will be classed as a repeat offender.
The 24-year-old star's other legal troubles stem from a 2007 driving under the influence (DUI) arrest, while in January she completed a 90-day court ordered stay in rehab.
