Bernstein Liebhard Reports on New Study Suggesting DePuy Hip Failure Rate as High as 49 Percent

On March 9, 2011, a U.K. study revealed that 1 out of 2 DePuy ASR XL hip implants could potentially fail.  Researchers from the British Orthopaedic Association and the British Hip Society presented four sets of data during last week’s British Hip Society Annual Conference.  Their findings suggest that DePuy ASR XL hip replacements have a 49 percent failure rate after six years.  This means that half of the individuals who received a DePuy ASR XL hip replacement are likely to need revision surgery within six years of the implant date.  The lawyers at Bernstein Liebhard LLP are currently investigating and litigating cases on behalf of Bernstein Liebhard’s clients who have undergone DePuy hip implant surgery and are offering free and confidential legal consultations to individuals who received the defective hip implants.

DePuy ASR XL Hip Failure Rate is Four Times Greater than Initially Thought

In August 2010, DePuy recalled both the ASR XL and ASR hip resurfacing system, citing a 12 to 13 percent failure rate in patients within five years.  This latest study reveals that the failure rate is four times greater than what DePuy cited when it issued the recall.  Specifically, the study found that the rate of revision surgeries ranges from 21 percent after four years to 49 percent after six years.  However, even these numbers may underestimate what has already become a widespread public health and safety issue.  The group noted that the 21 percent revision rate at 4 years could rise to 35 percent “if all currently known painful implants progress to revision.”  

Prior to the August 2010 recall, an estimated 37,000 ASR XL hip replacements were sold in the United States.  To date, DePuy is defending more than 500 hip replacement lawsuits, a number that is likely to skyrocket.  Additionally, there are growing concerns surrounding other DePuy hip models.  Last week, David Floyd, president of DePuy’s artificial hip division, announced his resignation from the company.
