Charlie Sheen will go to court on Tuesday after his estranged wife Brooke Mueller refused to take a drugs test.
Brooke reportedly turned down a test at her Hollywood home yesterday afternoon (15.04.11), meaning the troubled actor will return to court, possibly to ask for temporary custody of his two-year-old twin sons Bob and Max.
The pair - who have both had a well documented battle with addiction - are bound by a pre-divorce agreement to undergo random drugs tests three times a month.
A source told RadarOnline.com: "Charlie will be going to court on Tuesday to address Brooke's refusal to take the test.
"He may ask the court for the temporary custody of the boys if Mueller agrees to enter rehab. Charlie is concerned for Brooke, but his first priority is the boys and their safety."
Brooke recently agreed to take weekly drugs tests until Bob and Max were 18 as she was left "shaken" after Charlie threatened to decapitate her and put her head in a box to her mother.
She has also defended her parenting, saying she was a "good mother".
Brooke said: "The boys are having a wonderful time. Everybody's healthy and happy.
"When people say all those mean things... oh yeah, I think, get a life. I would say about 50 per cent of the time they're lies. The only thing I care about is that people know I'm a good mother."
