Man Wants Kidney Back in Divorce

A New York man is demanding that his estranged wife give him back his kidney or pay him the value of the organ – over $1 million.

Dr. Richard Batista wed his wife Dawnell in 1990 but their marriage soon began to fall apart. They soon learned that Dawnell would die if she did not have a kidney transplant. Batista was a match and he donated his kidney to save her life and try to salvage their marriage.

Dawnell Batista's body accepted the kidney but her marriage to Dr. Batista failed. She filed for divorce after Batista accused her of having an affair with her physical therapist. Batista is now demanding that Dawnell return his kidney or pay him a million and a half dollars.

“That is part of the litigation. We are asking for the value of the kidney that he gave his wife,” Batista’s divorce attorney says.

“There’s no deeper pain that you can ever express than the betrayal of someone you loves and devoted your whole life to,” Batista says of the divorce. “I felt humiliated and betrayed, disrespected and disregarded for me as a person as a man as a husband as a father.”

The Batista’s divorce case is the first of its kind in New York state.
