Supreme Court of New Jersey Centralizes DePuy ASR Hip Implant Lawsuits

On April 12, 2011, the Supreme Court of New Jersey issued a Notice to the Bar announcing that all pending and future New Jersey state court cases involving the defective DePuy ASR hip implants be assigned to Superior Court Judge Brian R. Martinotti in Bergen County for centralized management purposes.  Although the New Jersey Supreme Court did not designate the DePuy ASR hip implant lawsuits filed in the state as a “mass tort,” the lawsuits will still be subject to a coordinated discovery process under Judge Martinotti.  The lawyers at Bernstein Liebhard LLP are currently investigating and litigating cases on behalf of Bernstein Liebhard’s clients who have undergone DePuy ASR hip implant surgery and are offering free and confidential legal consultations to individuals who received the defective hip implants.

Although the Supreme Court of New Jersey did not grant the DePuy ASR hip implant lawsuits “mass tort” status, the Supreme Court did conclude that the allegations in the individual lawsuits against DePuy are substantially similar and warrant centralized management and coordination under one judge for pre-trial purposes.  In New Jersey, lawsuits designated as “mass tort” status are consolidated as well as coordinated and centralized.  Even though the DePuy ASR hip lawsuits were not consolidated, one should not infer that plaintiffs’ claims that design defects in the ASR hip implants caused them to sustain hip replacement failure or metal poisoning makes DePuy any less culpable or responsible for plaintiffs’ injuries.
