Effective June 1, the Florida minimum wage will increase from $7.25 to $7.31 per hour. The new minimum wage for tipped employees will also rise by 6 cents from $4.23 to $4.29 per hour.
On May 2, Leon Circuit Judge Terry Lewis ruled in favor of groups representing Florida workers stating that the Agency for Workforce Innovation miscalculated the
Florida minimum wage, costing employees approximately 6 cents per hour. The ruling came in a lawsuit which alleged that the state used an erroneous formula to calculate yearly adjustments to the Florida minimum wage, instead of utilizing the method required by state law. According to the lawsuit, this formula resulted in a decrease to the 2010 minimum wage for Florida employees and would have held down future increases by accounting for a small dip in 2009’s estimated cost of living. Judge Lewis found that while the
Florida minimum wage can be increased to account for inflation, it cannot be decreased in rare instances when the cost of living falls. The ruling will affect 188,000 employees in Florida, and those working 40-hour weeks can expect to see an additional $128 annually.
