Future of DePuy Pinnacle Hip Implant Lawsuits to be Determined by U.S. Judicial Panel on Multidistrict Litigation

On May 16, 2011, the U.S. Judicial Panel on Multidistrict Litigation (“JPML”) gathered at the Gene Snyder U.S. Courthouse in Louisville, Kentucky, to determine whether DePuy Pinnacle hip implant lawsuits pending in federal courts nationwide should be centralized for pre-trial purposes.  If the panel determines that centralization of the DePuy Pinnacle hip implant lawsuits is appropriate, the panel must then decide whether the lawsuits should be consolidated into their own MDL, or in the alternative, made part of the DePuy ASR hip implant MDL, which is currently underway in the U.S. District Court for the Northern District of Ohio.  The lawyers at Bernstein Liebhard LLP are currently investigating and litigating cases on behalf of Bernstein Liebhard’s clients who have undergone both DePuy Pinnacle and DePuy ASR hip implant surgery and are offering free and confidential legal consultations to individuals who received the defective hip implants. 

In August 2010, DePuy issued a nationwide recall of all ASR hip replacement implants.  Although the Pinnacle was not included in the recall, it has much in common with the recalled ASR hip implants, as both are metal-on-metal hip replacement devices.  Thus, Pinnacle hip implant recipients often experience hip replacement failure symptoms akin to that of patients who received the ASR hip devices.

Possibilities for DePuy Pinnacle Hip Implant Lawsuits

Although the original petition for centralization of the DePuy Pinnacle hip implant lawsuits was made by an individual plaintiff, DePuy agreed that that the lawsuits should be consolidated.  However, since the petition was originally filed on March 25, 2011, several other plaintiffs have come forward and either opposed consolidation or proposed alternate venues.   Thus, the JPML will first have to decide whether the DePuy Pinnacle hip implant lawsuits involve common questions of fact such that they should be consolidated with the DePuy ASR hip implant MDL.  If the JPML determines that consolidation is appropriate, but that the DePuy Pinnacle hip implant lawsuits warrant the formation of a separate, new MDL, it must then determine a proper venue.
