DePuy Pinnacle Hip Implant Lawsuits Consolidated in the Northern District of Texas

On May 23, 2011, the U.S. Judicial Panel on Multidistrict Litigation (“JPML”) ordered that all DePuy Pinnacle hip implant lawsuits pending in federal courts nationwide be consolidated and centralized in the U.S. District Court for the Northern District of Texas and assigned to Judge James E. Kinkeade.  Last week, the JPML convened at the Gene Snyder U.S. Courthouse in Louisville, Kentucky, to hear oral arguments as to whether the DePuy Pinnacle hip implant lawsuits should be centralized.  On March 25, 2011, Catherine Falvey, a plaintiff in one of the DePuy Pinnacle hip implant lawsuits filed a motion to centralize three of the actions pending in federal courts.  The lawyers at Bernstein Liebhard LLP are currently investigating and litigating cases on behalf of Bernstein Liebhard’s clients who have undergone both DePuy Pinnacle and DePuy ASR hip implant surgery and are offering free and confidential legal consultations to individuals who received the defective hip implants. 

In August 2010, DePuy issued a nationwide recall of all ASR hip replacement implants.  Although the Pinnacle was not included in the recall, it has much in common with the recalled ASR hip implants, as both are metal-on-metal hip replacement devices.  Thus, Pinnacle hip implant recipients often experience hip replacement failure symptoms akin to that of patients who received the ASR hip devices.

DePuy Pinnacle Hip Implant MDL

In reaching its decision to form a DePuy Pinnacle hip implant MDL,  the JPML determined that there were common questions of fact to warrant the transfer of the these actions for consolidation to one federal district court for coordinated and consolidated pre-trial proceedings.  In addition to the 57 DePuy Pinnacle hip lawsuits currently pending in federal courts nationwide, the JPML also recognized that there are other potential tag-along actions that should be included in the newly established DePuy Pinnacle hip implant MDL.  The panel reasoned that it did not want to “limit the scope of this MDL docket” given the early stage of the litigation.
